I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?

The situation is my GC application is ongoing, while I am presently working on EAD(based on husband's application). If I change my job, within the same company, and move from one job family to another(within IT itself), what is the impact to,

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.
FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

I renewed EAD twice using e-file. So far it was all smooth. Very first time I had paper filed and went for FP-ing. Since then renewed twice for myself and my wife - no FPing...got the card smoothly. Again this is USCIS .. someone might have had completely different experience...

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.
I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?
Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?
I will appreciate your help.

Hello Folks,
My H1b is 2 and half years old. I transferred it once, i.e in 2007
My brother has got GC a year ago and started his own company. I am planning to transfer it to him.
I have these following questions.
1. What is the risk on transferring my H1 to a new/small company in this recession period, and the employee strength is just one (my brother).
2. Is it ok to transfer more than one time in short period(i.e in 2 years span)?
3. Also, is it acceptable to stay outside US for couple of months on H1 status with out payroll? Will that be a problem at POE when i return to US?
4) Right now i am out of the project (on bench), so will that be any risk of my H1 transfer getting denied ?
Please help!

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

State Department explains that the reason for this is that it is still too early to see what impact the movement of the cut-off dates toward the end of FY-2007 may have on demand. Depending on the rate of demand being received from Citizenship and Immigration Services offices for adjustment of status cases, some forward movement of dates may be possible for December.

I requested for a document that got returned as undeliverable to be resent.
I first requested CSR and she gave me a referrral#.
Same day I spoke with IIO and she made the request again for me(before I could tell her I spoke with CSR)
Today I spoke with a CSR and gave her the referral# that the CSR gave me last week and this lady says she didn't find any information related to this referral# .She did say it does surprise her. She also said she will open a new request .
I was concerned if that will be kind of duplication of the work done by CSR & IIO last week and she said there is no need for such concern.
What does all this mean?
They open a request , give you a referral# and tell you the document will get mailed in 3-5 business days .
IIO says she has placed a request.
You go back after a week , and referral# has no information attached to it and this CSR says she 'll open new request.
Anybody has any idea?

It asks for Alien Registration Number (In section 5) - can anyone tell me what to fill this up with, since I do not have Green card?
