    I probablly know the answer to my own question, but would like to know other opinions. My lawyere tells me this. Since the dates were current when I filed for my I485 in July, the application will be processed regardless of what the dates are right now. Another words, he thinks that even though the dates are showing as 2002, my application will be processed since when we filed, they were current.

    is this true. If so, then provided I pass background check in time, i should expect my GC in a year or so. but if I have to wait until 2002 Row becomes current, in my case 2005.. then I am majorlly scrwed...

    Your application will be processed until the stage where a visa number is needed to adjudicate your case. Since EB3 (am assuming here) ROW is not current. Your app will wait until visa numbers for your category becomes current. In other words, your last sentence may be true. But not if you become vocal about your plight and fight for it through activism (i.e by supporting Immigration Voice).

    Yes if you are born in India, then US skilled immigration is closed for EB2/3...its over..finished. I realized this in 2005 itself and started preparing, applied for Canada
    PR in 2006. Took GMAT and applied for MBA. I only applied for Canadian schools...not 1 US school...I learnt my lesson...fool me twice shame on me. In 2007, I got my Canada PR
    and well my MBA admission. I paid resident tuition fees, got loans from Banks as I was a PR. The plan worked picture perfect.

    Interestingly when I was applying for my MBA in Canada, one friend of mine was preaching to me to do in US and not Canada....well guess what ...he got his a** handed over to him and lost his job and is back in India. He applied to US top schools and thankfully he didnt get admission. Overwise I dont know what would have happened.

    I am in touch with Indian student in US B-schools like Harvard as well. Their life is living hell now with 20+ lakh loans in India with parent's home as collateral. Employers run away like seeing ghosts moment you mention H1B.

    why didnt ur friend apply for MBA in canada?....i think a lot of people have misconceptions and pre-conceived notions about canada.......they think of US as the best and canada does not even figure in their list of options......i have got fooled once into h1b to US unaware of the broken immigration system.......wont happen again......i believe the ones in US on h1b visa from india should spread the word about the pathetic EB 2/EB3 india scenario so that no one else gets lured into US by h1b candy

    I got the same email this morning and status said EAD was ordered on june 30th.
    I am pretty sure we will get a 2yr EAD but will just have to wait 2 more days to confirm this.... I wonder if they are looking at the current status and if you are on h1b they are issued 1yr and processed it before june 30, while if you are currently on EAD, they kept them until June 30th.. I doubt it but just a theory...
    Your theory is wrong. I am on H1B and not on EAD. My application was recieved on 06/20 and till today no changes.

    Thought this may be some helpful information. I contacted an attorney and she showed me a recent circular (dtd. Spet 26) from AILA about premature I-485 approvals and how that can be corrected through an AILA liasion. So, Alias, looks like your attorney followed the same procedure.

    I usually don't reply to threads which waste my precious hours during the most productive time of the day. I just couldn't help observe how retarded this person is. His handle talks great about his country. WTF is he doing here? And I assume he is on H1B. Is it fair to say he was raped by some company too? And what do you mean there is no difference between those illegal immigrants and us? Seriously, I just hope you are not retarded to a point that your stupidity is causing an aura of imbecility around you. Your heart ain't broken its just abnormal. By the way, the moment you start labeling people as smart and not so smart, you have underestimated something called "TALENT". No one promised that if you went to DC you are going to get your GC. Your real reason is that you are hiding under the excuses of your mind blaming the system, the people who use the system and the people who are used by the system. Do remember that you are part of the system and your actions, however futile they may get(which i doubt cuz you will be blaming the system for the next 20yrs), will still be governed by the system and not by your petty thoughts.

    This post does clarify visa recapture issues, but what about concurrent 140/485 filing ? Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?


    Here is an update on Visa recapture from Aman:

Infact as it stands right now, even H-1B increase will also not happen outside of comprehensive bill. Reason? Most of the groups and companies have stopped pushing for temporary relief because any kind of temporary relief or interim relief chips away support from CIR and the offices of Senate and House Leadership along with other proponents of CIR have made it clear that any immigration relief has to be a part of CIR and not outside of it. Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. So it would be counter-productive politically to do things that take away good stuff from CIR. Also, if you think that any effort in the final week could help in anyway, then let me to share with you that most provisions and their language are decided much in advance and last minute efforts almost never yield any result on the Hill."

    Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

    aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.

    the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
    this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)

    no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!

    so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

    where were you when USCIS implemented vertical spillover in 2006 and left EB2 I in a U state while giving EB2 Gc numbers to EB3 ROW?
    did you object then? did you start a campaign? did EB2 I folks here start saying that iv did not care about them?

    in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.

    and i see here a comment that every campaign has been bad for EB3 india.
    i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

    It is good to know that state chapters are semi internet. I beg to differ with you regarding "feeling that you are in trouble". Expecting people to feel that they are in trouble by telling them so will never work. If someone thinks they are in trouble they would work out the solution on their own, they will not sit and wait for someone to help. This is a flawed assumption.

    Anyways I am going to join the IV chapter to share more of my ideas to help this cause. Already sent a PM to chanduv23

    State boards are kind of semi internet usgae only (Though not forum...). But those also do not make passive ones come ahead. So real issue is not the type of meet, the first real issue is feeling that you are in trouble..and 2nd is to stand up for fighting against that. And 3rd.. yes through IV we will be able to do this and so become active.

    I have a question in case any experts come back today to visit this thread.
    Its reg the point system. We get points for employer sponsorship and number of years of US employment right?
    1) If a person has been working here for 4 years on H1b in STEM decided to leave to canada this week. He then comes back lets say in 2008 or 2009 and then wants to apply for GC. Will he get points for the previous 4 years, even though there was a break in service (canadian trip) for 1-2 years?
    I need to know this because I am contemplating moving to canada (my current employer has filed for LC, which I will then be nullifying). Ofcourse I intend to renter after 1 year or so.
    2) My seccond question-- I am also planning to start a new GC before leaving to canada. Can GC application proceed while you are out of the country? If so until what stage?

    Can you pls post their names/IV handles, so that everyone know who those cowards are ? I am sure a lot of them masquerade as experts on this website, but dont bother to move their butts when needed :mad:

    We will not achive anything by this. Please do not post any name IMHO. Yes we have issues but nothing can be resolved by getting angry. All such posts are only going to aleinate those who are looking for a meanigful excahnge. Why get into mudslinging. When some one like 'logiclife' is expressing didain then he has full right to do so after having given so much to this cause. Let us all be the antidote to this issue by keep the process of encouraging/informing/inviting our friends/collegues after such experiences. Impatience will not get us anywhere. Nobody said this will be easy. So let's get at in every possible way.

    'needhelp' may very well need more help to do such things in the future!!! well a lesson learnt is knowledge gained.

    How can one know if ones employer has withdrawn/cancelled ones H1B visa? Apart from asking the employer, if one uses the EAC # ans checks the status on www.uscis.gov, will it be reflected over there?

    Q: Can an employer cancel H-1B visa without employee�s knowledge/consent?
    A: Yes and remember it is illegal to travel on a cancelled visa.

    Q: If an employer can cancel my visa without my knowledge, how do I know that my visa is still valid?
    A: Unfortunately, the only reliable source for that information is INS and your employer. There is really no other way to find out. You could try INS although they may not help you as you are an employee.

    Was listening to NPR today and some anti-immigration group apparently sent 700,000 web faxes/emails to get the current CIR bill down. Try matching that at IV... Also mentioned that their members called the lawmakers in thousands.

    I e-filed my EAD renewal on May 9th...sent documents to TSC...there were couple of LUDs but not EAD yet.
