I have already expressed my intention to sue the US government for the money I have put for so many years in the SS and Medicare funds when I leave the country. There will be always a greedy American lawyer (only one ?! :-) ready to get this done for one third of the prey. And I will still get back two thirds of my money. Much better than nothing.
And imagine that a bunch of "mirage chasers" like me unite and make it a class-suit, and everybody around the world who has been legally here and paid his taxes hears that and asks for his/her money back... The tick-skin-fat-ass politicians and government officials will suddenly become very nice, considered and cooperative (now they are just nice), the PBEC would miraculously clear the backlog within 6 months, the retrogression will disappear etc, etc.
Well, most probably all this will never happen but you never know, the snowball may start rolling... They are too many frustrated people in this mess...

I have a suggestion we need to meet the senators office in person and also try to get more visibility in terms of getting exposed to media may be channels like
a) AZN TV
b) India waves
c) CBS
d) NBC

I am not entirely sure about the 1% number. I feel it may be somewhat higher than that.
If indeed the ratio is 1%, then things are very dire, since with the economy as it is, we probably will not see any expansion in EB immigration in the near term.
Additionally the L1-EB1 route as multinational manager is very much alive and well, and is arguably the preferred and probably only viable route for any Indian prospectively attempting to immigrate to the USA. The numbers of such applicants might be larger than we know. If anyone has any data on that and specifically about the change in those numbers ever since retrogression hit, please post it.
In all honesty, I know the guys applying anew need a little hope and encouragement, but with perhaps 300K people and rising ahead of you in the EB India queue and slim to none chance of EB expansion in the near term, what are the odds of getting through that line in the next decade?

This is good news all around. It gives EB2 I an obvious benefit. However EB3 can take consolation in knowing that all EB2 is closer to C, and then spillover can start. Obviously EB3 ROW will get the spillover first, but then it will be EB3I. A visa recapture would be so great now.
Now perhaps RD matters if you are EB2 I.
This is just a hunch, however I think you will see a rash of EB2 India approval in the coming couple of months. I have seen a lot of LUDs and RFEs and the like on EB2I cased over the past month or two, and a lot of this seems as if they were pre-adjudicating, while in discussions to move the dates with the state dept.
A few lucky people from the July filers will get their green cards from this, but most may have to wait a while. They have not processed many of them.

USCIS has edited the reciept update of NEBRASKA EMPLOYMENT BASED I-485 TO 7/1/07.please go thru this link.This means it is still looking after the june end applications for reciepts.

Dont mean to dampen your spirits, happy for the poster of this thread. Could have been lucky to get approved while people like me ( Sep 2003) PD waiting 485 filed 3 yrs ago.

We have a one month window to push for HR 5882, let us focus on that. if it doesnt work then we have no hope. at this rate EB3 will not even move 6 months per year. In retrospect every minor gain for the EB community has had major implications to EB 3 and the backlog as a whole (just venting a bit, dont want to drag it into a big discussion). I remember last year there were many who were saying 'now that we have EAD and AP we are good', this year many will realize the additional pain of renewals and waiting.
Oh's site mentions the following (per country limit is both family and EB based)
"The numerical limits for FY-2008 are as follows: (a) Worldwide Family-sponsored preference limit: 226,000, (b) Worldwide Employment-based preference limit: 162,704. Under the INA Section 202(A), the per-country limit is fixed at 7% of the family and employment annual limits. For FY-2008 the per-country limit is 27,209. The dependent area annual limit is 2%, or 7,774.

This will depend on two factors

USCIS allocation strategy (Quarterly spillover or year end spillover)
From historic data I have seen some 15-25k visa spillover to EB2/EB3 India-China, this number varies based on demand of various EB categories each year.
With H-1B cap coming down in 2004 to 65000, demand should go down by a decent margin post 2004, since its the H-1B's which will lead up to the EB queue.
By the way Sachug/vdlrao, do we know if this will be yearly or quarterly spillover. If it is year end, what does this mean? September or July(beginning of last quarter)? And I am sure there is documentation about this new horizontal spillover method from USCIS, but I can't seem to find it. Could someone point me to that. Thanks!

Moreover since you are already filed 485 and its more than 6 months you are secure.
For rest the situation is precarious
As it relates to my green card application, my situation is relatively better than some. If you search my previous posts, you will note my similar expression of frustration a few months/years ago. I don't want to go into the details behind how justifiable my frustration felt at the time - those are facts that I can do nothing about.
So I gave up and quickly made plans to return to our homeland. I was lucky to have a moment of clarity about a month before pulling any triggers because shortly thereafter, I read Lance Armstrong's book - "It's Not About the Bike". "Man's Search for Meaning" by Viktor Frankl was another very inspring work for me. I have since read many books on similar subjects - some good and some not so good - but more importantly, I now believe, with all my heart, that how I feel is entirely up to me. Not only is it just up to me, I am 100% accountable for it.
I am not saying you shouldn't express your feelings or seek the comfort of friends when you want to. I am simply offering some details around what works for me and why I am not as frustrated as I once was.
My green card "struggle" - if you can call it that - no longer impedes my ability to enjoy this moment. There are more people-including children-facing far more significant challenges across all walks of life. I accept my green card situation for what it is. I work everyday on what I ought to be doing and strive to leave doubt and worry behind (per Huxley's age old advice). This works for me.
I would love nothing more for it to work for everyone.

Read the definition of EB-2, and its sub-classification for Advanced Degree, Exception abilities and National Interest Waiver.

I believe the 140 backlog is artificial. They processed only 2k cases in one month. How come they finished all EADs in 3 months for all June/July filers? There is something more to all this than meets the eye.
Bootmline is they want to make it hard for us one way or the other. Btw, I had just come out of BEC and got stuck with 140 now.
When did your labor process from BEC? Do you know if there are any pending cases with National processing center, which is the successor of BECs?
