was ur first MTR denied in error?
as per you, your I-140 was never denied.
My I-140 was never denied. In fact the date 09/04/2007 that NSC mentions about the denial is the date that I got approval notice. I have the approval copy from USCIS. I am not sure what the adjudicating officer is looking on his terminal.

no. of h1b issued in last 4 years 65kX4= 260k
even if you double that (which i m sure is not the case), still it come to 500k.
so ure over estimating it.
thanks
What about L1-A and L1-B? They are a lot too. 192,000-60,000 = L1 number each year.

Thanks.. Lets ask others to contribute and get ready for next big fight..
Thank you.
Contributed one time $100. Will not hesitate to do so in the future. Nice job IV!!!
Most media articles on the 485 issue had one common note "This normally not so vocal group of legal working immigrants have stood up and spoke". IV made sure that will not be so anymore and we have a strong resonating voice that will make a difference

How does that work? There is no law or process to connect an abandoned labor. I had approved labor with a PD of 1999 that got lost when I switched companies. But no one seems to be connecting that to me.
Its not a rumor. This is real. Coming to think abt it, he had filed a labor in 2000/2001 time period and had abandoned it when he switched companies. I am wondering if USCIS takes the oldest one an applicant had ever filed.

Well, if you do the direct calculations (eventhough it looks correct for most of us), it always results scary.
But that does not happen always. A Government Agency decided to accept that many applications in a month window, defintely it would not have been decided in a lunch or dinner meeting.
They should have known their limitations and how to handle the situation. If there are 20K 485 applications sitting at the storage, it would not create much problems. But it creates so much administration issues if the number is 600K applications.
One major issue is, every year they are going to receive 600K EAD renewals. They will never get time to work on 485, but life long working on renewing this EAD's and no more further GC processing.
So, its not going to be the case. Now they have money, even if it takes first year some more months, they may go for hiring more contracters OR spliting the applications across different centers processing them.
Its a big administration issue to the agency to keep all the applications pending than us.
So, no worries. There must be a solution ahead for us.

priti8888,
That is not true. Receipt Date is when the service center physically receives the package. They date stamp it and then use it to enter that RD when they generate the Notice on the ND.
What you see on the status page for sure reflects the ND and NOT the RD. So you can pretty much ignore what the status page says and rely on what your physical notice says (it states the actual RD when they physically received the package!)
Hope this is a clear explanation.
Oh really!..then i might be wrong. So RD is before the ND
THANKS Shreekhand

IV has changed our lives.
Folks - look back at the situation beyond last year
Retrogression
Desi employer blood sucking
Labor issues
Companies closing down
No job promotions no salary hikes
CIR Draconian bill
Durbin Grassley bill
July fiasco
Look at the difference IV made
Constant grassroots lobbying - bringing awareness
Extreme dedication of all volunteers - kept IV going
Trust and faith - providing confidence and support
Hard work and faced criticism in a positive manner
Flower campaign during July fiasco - visa bulletin reversal
September 18th massive rally - first time IV could manage to stage a rally with nearly 2000 highly skilled workers from around the country
Media awareness
Working with lawmakers
Admin fix campaign
2 year EAD
Working on Lofgren bills
Brought the entire community under one umbrella
Discussion forums - a source of knowledge
Tracking help
Folks - let us all be thankful that IV has been there for us. This is the best thing to happen to the community.
Please do not resist from contributing. It is diifficult for the first time, but once you do it - you will be happy.

Hi Tina,
Thanks for your reply. I am in Eb3. I am willing to relocate but you know that every state has different rules for Physical Therapists. As I have 3 yrs of experience from India, I wonder who can sponsor me.
A lot of employers are willing to sponsor Schedule A applications, as far as you get your own lawyer & bare the costs, especially if they don't have an immigration department. So you may want to let them know that you have a lawyer who can file as soon as. Some employers already have the employment notice.
You may already know these, but here goes

Delays at DOL PERM Processing Center in Atlanta to End Soon!
Posted May 11, 2007
MurthyDotCom
A number of inquiries have come to us regarding delays in PERM labor certification case adjudication. Beginning early in 2007, there has been a noticeable slowing in case processing at the U.S. Department of Labor (DOL) Atlanta Processing Center. This center is one of two locations where PERM labor certifications are adjudicated. The other location is in Chicago. This slow-down is a marked change from the generally fast PERM labor certification decisions that had become the norm.
MurthyDotCom
Personnel Reassigned to H2B Cases
MurthyDotCom
We at the Murthy Law Firm made inquiry about this matter, to gain some insight into why things had changed, and, of course, to determine how the situation might be improved. We were advised that personnel temporarily had been reallocated away from the PERM cases. The Atlanta Processing Center also processes temporary labor certifications needed in H2B cases. Due to demand and time constraints, personnel were diverted to work on the temporary labor certifications, which meant delays in the PERM labor certifications.
MurthyDotCom
Changes Expected in the Near Future
MurthyDotCom
Our sources indicate that the DOL adjudicators in Atlanta will be moved back to their regular responsibilities of processing PERM cases in the near future. Thus, PERM cases there should start moving again soon.
SKY,
I am in the same scenario as you since my firm is headquarted in NY . Can you check with your attorney about the processiing times they are seeing for labors filed with the Atlanta processing center . My law firm says that the processing times are more or less the same for Atlanta and Chicago .

In the last 1 months, how mcuh time is it taking for just the labor to be cleared. Not the pre-labor work. Just labor.
Thank you,.
PERM is getting approved in less than 4 weeks after filing if there is not audit.
